Woodland Forest Estates Covenant Violation Protocol

One of the missions of the Woodland Forest Estates HOA Board (Board) is to enhance the property of our subdivision by upholding our covenants to preserve property values. The Board will serve the Homeowners by taking a fair, ethical and objective approach in representing the interest of all members of the association.

Below is the protocol the Board follows in seeing to covenant preservation in our neighborhood.  A ride-through of the subdivision is done, on average, monthly to oversee covenant compliance. It is understandable that some violations occur unknowingly, which is why a grace period is extended. The Board aims to function with neighborly graces, while keeping with its mission to uphold the covenants. Covenant Violation Protocol

  1. Violation identified of HOA covenant.
  2. After some time without correction of violation (minimum a few days), notification letter is sent to homeowner stating:
    • the associated ruling covenant,
    • identifying the noted violation, and
    • asking the violation to be corrected in a specific amount of time (grace period – minimum a few days).
  3. If violation is not corrected within the grace period, a second notification letter is sent to the homeowner:
    • referencing the initial notification letter & its contents,
    • noting the covenant violation has still not been corrected,
    • asking again that the violation be corrected within a specific amount of time (2nd grace period – minimum a few days), and
    • stating if it is not corrected by that time that the matter will be forwarded to the HOA Attorney for further action.
  4. If violation is still not corrected within the 2nd grace period, all the documentation will be turned over to the HOA Attorney who will issue a legal notification to the homeowner:
    • referencing the previous notifications and
    • stating if the violation is not corrected within a specific amount of time (3rd grace period – minimum a few days), legal action will be taken.
  5. If violation is not corrected within the 3rd grace period, the HOA Attorney, with direction and approval of the HOA Board, will initiate proper legal action (i.e. lawsuit/injunction) against the homeowner to gain compliance of the covenant and correction of the violation. 

Note: 

  • Correction of a covenant violation noted within steps 1-4 above will terminate the process unless the violation happens again within a year time frame that the first covenant violation was suspended. In this case, the covenant violation will enter the Progressive Corrective Process at the level it was suspended and not higher than step 3. If a minimum of a year time period has elapsed since the suspension of the covenant violation, the Progressive Corrective Process will start at the beginning (Step 1).
  • Per the established covenants, any homeowner and/or the HOA Board has a right to legal action (i.e. lawsuit/injunction) as well as being entitled to recovery of all attorney fees, court costs, and damages given the successful prosecution of such legal actions to correct covenant violations.
